Terms of Service

These Terms of Service (“Terms”) govern your use of the Stoppy mobile application (the “App”), operated by Andrey Kokin, a sole proprietor based in Cyprus (“we”, “our”, or “us”), reachable at stoppy@stoppy.xyz.

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Stoppy is a self-help tool to support people who are quitting nicotine products (cigarettes, vapes, snus). The App provides:

  • A personalized recovery timeline based on inputs you provide
  • A live tracker for money saved and time since your last use
  • Guided breathing exercises for craving moments
  • Milestone celebrations and motivational content

Stoppy is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease, nor to replace professional medical, psychological, or addiction-recovery advice. See Section 5 for the full medical disclaimer.

2. Eligibility

You may use the App only if you are at least 13 years old. If you are between 13 and 16 (or the age of digital consent in your country), you confirm that a parent or legal guardian has reviewed these Terms and agreed on your behalf.

You may not use the App if you are prohibited from doing so under the laws of your country of residence.

3. Subscriptions and payments

3.1 Subscription model

Stoppy is offered as a paid subscription with a free trial. There is no free tier. After you start a free trial, your subscription will automatically renew at the price disclosed at the time of purchase unless you cancel before the trial ends.

3.2 Plans

Current plans (subject to change; the in-App display at the time of purchase is the binding price):

  • Annual — €29.99/year, with a 7-day free trial
  • Weekly — €2.99/week, with a 3-day free trial
  • Lifetime — €59.99 one-time payment, no subscription

Prices may vary by country and currency.

3.3 Billing

All purchases are processed by Apple via the App Store. We do not process your payment information. Your subscription is tied to your Apple ID.

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Renewals are charged to your Apple ID at the rate disclosed at the time of purchase.

3.4 Cancellation

You can cancel your subscription at any time by going to:

iOS Settings → Apple ID → Subscriptions → Stoppy → Cancel Subscription

If you cancel during the free trial, you will not be charged. If you cancel after the trial has converted to a paid subscription, you will retain access until the end of the current billing period; no refund is issued for unused time.

3.5 Refunds

Refunds are handled by Apple under their App Store refund policy. Request a refund at https://reportaproblem.apple.com. We cannot issue refunds directly.

3.6 Lifetime plan

The “Lifetime” plan is a one-time payment that grants access for as long as the App remains available on the App Store and is owned and operated by us. “Lifetime” does not mean perpetual access regardless of business continuity; if Stoppy is discontinued, the App and Lifetime access will end.

3.7 Price changes

If we change subscription prices, the new price will apply to your next renewal. We will notify you within the App at least 30 days in advance of any price increase. You can cancel before the new price takes effect.

4. Your account and data

If you create a Stoppy account (optional), you are responsible for keeping your credentials secure. Notify us at stoppy@stoppy.xyz if you suspect unauthorized access.

You can delete your account and all associated data at any time from within the App (Settings → Delete Account).

Use of the App is governed by our Privacy Policy, available at https://stoppy.xyz/privacy. The Privacy Policy is incorporated into these Terms by reference.

5. Medical disclaimer

Stoppy is not a medical service and we are not medical professionals. The content in the App, including milestone descriptions, recovery timelines, and breathing exercises, is for informational and motivational purposes only.

  • We do not provide medical advice, diagnosis, or treatment.
  • The recovery timeline shown in the App is based on general scientific consensus and may not reflect your individual situation.
  • If you are experiencing severe nicotine withdrawal symptoms, mental health distress, or any medical emergency, contact a qualified healthcare professional immediately.
  • Always consult your doctor before making changes to your health regimen, especially if you have pre-existing medical conditions, are pregnant, are breastfeeding, or take prescription medication.

The App is a self-help tool, not a substitute for professional care.

6. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, or attempt to extract source code from the App (except where permitted by applicable law)
  • Bypass or attempt to bypass the subscription paywall or any other access control
  • Resell, sublicense, or commercially exploit the App or its content
  • Misrepresent your age or identity to use the App
  • Use the App in a way that interferes with other users or with the App’s servers

We reserve the right to suspend or terminate your access if you violate these Terms.

7. Intellectual property

All content in the App, including text, images, mascot designs (“Pandy”), code, and audiovisual elements, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not transfer any ownership.

8. Third-party services

The App uses third-party services to function (Apple App Store, RevenueCat for subscription management, Supabase for optional account hosting, Expo for builds, anonymous analytics). Use of these services is governed by their own terms and privacy policies, summarized in our Privacy Policy.

We are not responsible for the practices of these third parties.

9. Disclaimers and limitation of liability

9.1 As-is basis

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, or that it will produce any specific outcome (such as quitting nicotine successfully).

9.2 Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any:

  • Indirect, incidental, consequential, special, or punitive damages
  • Loss of profits, revenue, data, or use
  • Health, medical, or psychological outcomes resulting from your use of (or inability to use) the App

Our total aggregate liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim.

9.3 Consumer rights

Nothing in these Terms limits any non-waivable rights you have as a consumer under applicable law, including under EU consumer protection law, UK consumer law, or the laws of your state or province.

10. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the App.

This Section 10 does not apply to claims that cannot be waived under applicable consumer law.

11. Termination

You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App.

Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnity, governing law) will continue in effect.

12. Governing law and disputes

These Terms are governed by the laws of Cyprus, without regard to conflict-of-law principles.

For users in the European Union: nothing in this Section affects your right to bring proceedings before a court in your country of residence under applicable EU consumer law.

For users in California: nothing in this Section waives your rights under California’s small claims court provisions.

12.1 Informal resolution first

Before filing a claim, please contact us at stoppy@stoppy.xyz. Most issues can be resolved this way.

12.2 EU online dispute resolution

If you are in the EU, you may use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

13. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you within the App at least 30 days before the change takes effect. Continued use after the effective date constitutes acceptance. If you do not agree, you may cancel your subscription and stop using the App.

14. App Store EULA

If you are using the App on an Apple device, you and we both acknowledge that:

  • These Terms are between you and us only, not Apple.
  • Apple has no obligation to provide support for the App.
  • In the event of any conflict between these Terms and Apple’s standard EULA for App Store apps, Apple’s EULA governs.
  • Apple is a third-party beneficiary of these Terms and may enforce them against you.
